Allgemeine Geschäftsbedingungen (AGB)

Artikel 1: Geltungsbereich & Anbieter
(1) Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle Bestellungen, die über meine Verkaufspräsenz auf der Plattform Payhip zwischen mir, Ronny Wollmann (nachfolgend "Verkäufer" oder "ich"), und Ihnen als Kunden (nachfolgend "Kunde" oder "Sie") geschlossen werden.
(2) Die Webseite naturwandel.com dient ausschließlich der Präsentation meiner Waren. Der technische Bestellvorgang und die Zahlungsabwicklung erfolgen über den externen Dienstleister Payhip Ltd. (Vereinigtes Königreich).
(3) Verbraucher im Sinne dieser AGB ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können. Unternehmer ist eine natürliche oder juristische Person oder eine rechtsfähige Personengesellschaft, die bei Abschluss eines Rechtsgeschäfts in Ausübung ihrer gewerblichen oder selbständigen beruflichen Tätigkeit handelt.
Artikel 2: Vertragsschluss
(1) Die Darstellung der Produkte auf meiner Webseite naturwandel.com oder auf Payhip stellt kein rechtlich bindendes Angebot dar, sondern eine unverbindliche Aufforderung zur Abgabe einer Bestellung (invitatio ad offerendum).
(2) Wenn Sie auf meiner Webseite auf eine Kauf-Schaltfläche klicken, werden Sie auf die Plattform von Payhip weitergeleitet. Dort geben Sie nach vollständigem Ausfüllen des Bestellformulars durch Anklicken des Buttons "Zahlungspflichtig bestellen" / "Kaufen" / "Jetzt kaufen" ein verbindliches Angebot zum Kauf der Waren ab.
(3) Unmittelbar nach Absenden Ihrer Bestellung erhalten Sie eine automatische Bestätigungs-E-Mail von Payhip. Diese Bestätigung stellt noch keine Annahme Ihres Angebots dar, sondern dokumentiert lediglich, dass Ihre Bestellung bei mir eingegangen ist.
(4) Der Vertrag kommt zustande, wenn ich Ihre Bestellung ausdrücklich annehme oder Ihre Bestellung zur Lieferung freigebe (z. B. durch Versand der Ware oder Bereitstellung des digitalen Produkts als Download). In der Regel geschieht dies innerhalb weniger Tage.
Artikel 3: Preise, Versandkosten & Kleinunternehmerstatus
(1) Die auf Payhip angegebenen Preise verstehen sich in Euro (€) inklusive aller Preisbestandteile.
(2) Ich bin Kleinunternehmer im Sinne von § 19 UStG. Es wird keine Umsatzsteuer berechnet und diese daher auch nicht auf Rechnungen ausgewiesen.
(3) Bei physischen Produkten kommen Versandkosten hinzu. Diese werden Ihnen im Bestellprozess klar ausgewiesen. Die Höhe der Versandkosten ist abhängig von Lieferadresse und Versandart.
(4) Bei digitalen Produkten (Downloads) fallen keine Versandkosten an.
Artikel 4: Zahlungsbedingungen
(1) Der Rechnungsbetrag ist sofort mit Vertragsschluss zur Zahlung fällig.
(2) Die Zahlung erfolgt über die von Payhip angebotenen Zahlungsmethoden (insbesondere PayPal, Stripe, Kreditkarte). Ich habe zu keinem Zeitpunkt Zugriff auf Ihre vollständigen Zahlungsdaten.
(3) Bei Zahlungsverzug können Verzugszinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz p. a. verlangt werden.
Artikel 5: Lieferung (physische Produkte)
(1) Die Lieferung erfolgt an die von Ihnen im Bestellvorgang angegebene Lieferadresse.
(2) Die Lieferzeit innerhalb Deutschlands beträgt in der Regel 3-7 Werktage nach Zahlungseingang. Bei Lieferungen ins Ausland kann die Lieferzeit abweichen.
(3) Sollte ein Paket auf dem Versandweg verloren gehen, werde ich eine Nachforschung bei dem beauftragten Versanddienstleister (z. B. DHL, Deutsche Post) einleiten. Kann das Paket nicht aufgefunden werden, erhalten Sie entweder eine Ersatzlieferung (sofern das Produkt noch verfügbar ist) oder eine vollständige Erstattung des Kaufpreises inklusive Versandkosten.
(4) Die Gefahr des zufälligen Untergangs oder der zufälligen Verschlechterung der Ware geht bei Verbrauchern erst mit der Übergabe der Ware auf Sie über.
Artikel 6: Digitale Produkte (Downloads)
(1) Nach Vertragsschluss erhalten Sie per E-Mail einen Download-Link von Payhip.
(2) Der Download-Link ist 30 Tage gültig. Innerhalb dieses Zeitraums können Sie das Produkt bis zu 3-mal herunterladen. Speichern Sie die Datei daher lokal auf Ihrem Gerät.
(3) Bei technischen Problemen mit dem Download unterstütze ich Sie – kontaktieren Sie mich einfach unter kontakt@naturwandel.com.
(4) Bereitgestellte digitale Produkte können aus technischen Gründen nicht zurückgegeben oder umgetauscht werden. Ihr gesetzliches Widerrufsrecht erlischt vorzeitig, wenn Sie ausdrücklich zugestimmt haben, dass ich mit der Ausführung des Vertrags vor Ablauf der Widerrufsfrist beginne (siehe Widerrufsbelehrung).
Artikel 7: Widerrufsrecht für Verbraucher
(1) Verbrauchern steht ein gesetzliches Widerrufsrecht zu, wie in der separaten Widerrufsbelehrung beschrieben.
(2) Besonderheit bei digitalen Produkten: Das Widerrufsrecht erlischt vorzeitig, wenn Sie ausdrücklich zugestimmt haben, dass ich mit der Ausführung des Vertrags vor Ablauf der Widerrufsfrist beginne, und Sie zudem bestätigt haben, dass Sie durch Ihre Zustimmung Ihr Widerrufsrecht verlieren. Diese Zustimmung hole ich im Bestellprozess über Payhip von Ihnen ein.
(3) Das Widerrufsrecht besteht nicht bei:
- Waren, die nach Kundenspezifikation angefertigt wurden oder eindeutig auf persönliche Bedürfnisse zugeschnitten sind,
- versiegelten Waren, die aus Gründen des Gesundheitsschutzes oder der Hygiene nicht zur Rückgabe geeignet sind (wenn ihre Versiegelung nach der Lieferung entfernt wurde).
Artikel 8: Unikate & natürliche Abweichungen
Viele meiner Produkte sind handgefertigte Unikate aus Naturmaterialien (z. B. Holz, Stein, Wolle). Geringfügige Abweichungen in Farbe, Form, Maserung oder Textur gegenüber den Produktbildern sind material- und herstellungsbedingt, stellen keinen Mangel dar und unterstreichen die Echtheit des Handwerks.
Artikel 9: Eigentumsvorbehalt
Bis zur vollständigen Bezahlung des Kaufpreises bleibt die gelieferte Ware mein Eigentum.
Artikel 10: Mängelhaftung (Gewährleistung)
(1) Es gelten die gesetzlichen Mängelhaftungsrechte. Für Verbraucher beträgt die Verjährungsfrist für Mängelansprüche bei neu hergestellten Waren zwei Jahre ab Lieferung.
(2) Für Unternehmer beträgt die Verjährungsfrist ein Jahr.
(3) Bitte reklamieren Sie offensichtliche Transportschäden sofort beim Versanddienstleister und informieren Sie mich.
Artikel 11: Vertragssprache & Speicherung
(1) Vertragssprache ist Deutsch.
(2) Der Vertragstext wird bei Payhip gespeichert. Sie können Ihre Bestelldaten jederzeit in Ihrem Payhip-Kundenkonto einsehen. Eine gesonderte Übermittlung des Vertragstextes durch mich erfolgt nicht.
Artikel 12: Online-Streitbeilegung
Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) bereit: https://ec.europa.eu/consumers/odr/. Ich bin weder verpflichtet noch bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
Artikel 13: Schlussbestimmungen
(1) Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts.
(2) Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. An die Stelle der unwirksamen Bestimmung tritt die gesetzliche Regelung.
(3) Gerichtsstand für Kaufleute, juristische Personen des öffentlichen Rechts oder öffentlich-rechtliche Sondervermögen ist mein Geschäftssitz (c/o Autorenglück, Hoyerswerda).

Terms & Conditions (T&Cs)

Section 1: Scope & Provider
(1) These Terms & Conditions apply to all orders placed via my sales presence on the Payhip platform between me, Ronny Wollmann (hereinafter "Seller" or "I"), and you as the customer (hereinafter "Customer" or "You").
(2) The website naturwandel.com serves solely for the presentation of my goods. The technical ordering process and payment processing are carried out by the external service provider Payhip Ltd. (United Kingdom).
(3) Consumer within the meaning of these T&Cs is any natural person who enters into a legal transaction for purposes that are predominantly neither their commercial nor their self-employed professional activity. Entrepreneur is a natural or legal person or a legally capable partnership that acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.
Section 2: Conclusion of Contract
(1) The presentation of products on my website naturwandel.com or on Payhip does not constitute a legally binding offer, but a non-binding invitation to place an order (invitatio ad offerendum).
(2) When you click on a purchase button on my website, you will be redirected to the Payhip platform. There, after completing the order form, you submit a binding offer to purchase the goods by clicking the "Place Order" / "Buy" / "Purchase" button.
(3) Immediately after submitting your order, you will receive an automatic confirmation email from Payhip. This confirmation does not constitute acceptance of your offer but merely documents that your order has been received by me.
(4) The contract is concluded when I expressly accept your order or release your order for delivery (e.g., by shipping the goods or making the digital product available for download). This generally happens within a few days.
Section 3: Prices, Shipping Costs & Small Business Status
(1) The prices stated on Payhip are in Euro (€) including all price components.
(2) I am a small business within the meaning of § 19 UStG (German Value Added Tax Act). No value added tax is charged and therefore not shown on invoices.
(3) For physical products, shipping costs are added. These are clearly indicated to you during the ordering process. The amount of shipping costs depends on the delivery address and shipping method.
(4) For digital products (downloads), no shipping costs apply.
Section 4: Payment Terms
(1) The invoice amount is due for payment immediately upon conclusion of the contract.
(2) Payment is made via the payment methods offered by Payhip (in particular PayPal, Stripe, credit card). I never have access to your complete payment data.
(3) In the event of late payment, default interest may be charged at 5 percentage points above the respective base interest rate per annum.
Section 5: Delivery (Physical Products)
(1) Delivery is made to the delivery address provided by you during the ordering process.
(2) The delivery time within Germany is typically 3-7 working days after receipt of payment. For deliveries abroad, the delivery time may vary.
(3) Should a parcel be lost in transit, I will initiate an investigation with the contracted shipping service provider (e.g., DHL, Deutsche Post). If the parcel cannot be located, you will receive either a replacement delivery (if the product is still available) or a full refund of the purchase price including shipping costs.
(4) The risk of accidental loss or accidental deterioration of the goods passes to consumers only upon handover of the goods.
Section 6: Digital Products (Downloads)
(1) After conclusion of the contract, you will receive a download link from Payhip via email.
(2) The download link is valid for 30 days. Within this period, you can download the product up to 3 times. Therefore, please save the file locally on your device.
(3) I will support you with any technical issues regarding the download – please contact me at kontakt@naturwandel.com.
(4) Digital products provided cannot be returned or exchanged for technical reasons. Your statutory right of withdrawal expires prematurely if you have expressly agreed that I may begin execution of the contract before the withdrawal period expires (see Withdrawal Policy).
Section 7: Right of Withdrawal for Consumers
(1) Consumers have a statutory right of withdrawal as described in the separate Withdrawal Policy.
(2) Special provision for digital products: The right of withdrawal expires prematurely if you have expressly agreed that I may begin execution of the contract before the withdrawal period expires, and you have confirmed that you are aware that you will lose your right of withdrawal by giving this consent. I obtain this consent during the ordering process via Payhip.
(3) The right of withdrawal does not apply to:
- Goods that are made to your specifications or are clearly personalized,
- Sealed goods that are not suitable for return for reasons of health protection or hygiene (if their seal has been removed after delivery).
Section 8: Unique Items & Natural Variations
Many of my products are handmade unique items made from natural materials (e.g., wood, stone, wool). Minor variations in color, shape, grain, or texture compared to the product images are due to the materials and manufacturing process, do not constitute a defect, and underline the authenticity of the craftsmanship.
Section 9: Retention of Title
Until full payment of the purchase price, the delivered goods remain my property.
Section 10: Warranty (Liability for Defects)
(1) The statutory warranty rights apply. For consumers, the limitation period for warranty claims for newly manufactured goods is two years from delivery.
(2) For entrepreneurs, the limitation period is one year.
(3) Please report obvious transport damage immediately to the shipping service provider and inform me.
Section 11: Contract Language & Storage
(1) The contract language is German.
(2) The contract text is stored with Payhip. You can view your order data at any time in your Payhip customer account. I do not provide a separate transmission of the contract text.
Section 12: Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Section 13: Final Provisions
(1) The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) Should individual provisions of these T&Cs be ineffective, the effectiveness of the remaining provisions shall remain unaffected. The ineffective provision shall be replaced by the statutory provision.
(3) The place of jurisdiction for merchants, legal entities under public law, or public-law special funds is my business seat (c/o Autorenglück, Hoyerswerda).
